In brief

Governs enforcement of judgments and instruments before the Board of Grievances, particularly judgments against or in favour of administrative bodies: filing and registering requests, time limits, compulsory enforcement and objections.

Summary of the law

Purpose and scope

  • Governs enforcement of final and provisionally enforceable judgments of the Board of Grievances courts and requires the judgment debtor to comply promptly (Article 2); an enforcement court or enforcement circuits in the administrative courts have jurisdiction (Article 3).

Key rules, rights and obligations

  • An enforcement request is filed with a statement giving the applicant's details, the instrument and attachments (Article 6).
  • The circuit notifies the government body to comply within five days for urgent judgments and thirty days otherwise (Article 10), may examine its budgets, posts and documents and order necessary measures (Article 11), and issues an enforcement order if the deadline passes or the body states it refuses (Article 12).
  • Where the instrument favours a government body, the circuit orders the other party to comply within thirty days of notification (Article 16).

Violations, penalties and common problems

  • For non-monetary enforcement the circuit may impose a fine of up to ten thousand riyals per day of delay (Article 20), which is settled on completion, impossibility or after six months and awarded to the applicant (Article 21).
  • A public official who abuses influence to prevent enforcement faces up to seven years and up to seven hundred thousand riyals, or either; one who deliberately refuses to enforce within their competence eight days after the warning faces up to five years and up to five hundred thousand riyals, or either (Article 30).

Procedures and key deadlines

  • Enforcement disputes are heard urgently, and an order staying enforcement suspends all steps and deadlines (Article 26); a dispute may not challenge the judgment itself (Article 27).
