Summary of the law
Purpose and scope
- Establishes the Alimony Fund under the Minister of Justice to ensure maintenance is paid to beneficiaries without delay (Articles 2 and 3); maintenance is the money a person is religiously obliged to spend on those entitled to it (Article 1).
Key rules, rights and obligations
- The fund pays maintenance to those with a judgment for it that has not been enforced for reasons other than insolvency, to those with a court order while their claim is pending, and temporary maintenance before judgment, which it later recovers (Article 4).
- The fund takes the beneficiary's place in claiming back from the obligor what it has paid on their behalf (Article 4).
- Payment is made on the beneficiary's application on the approved form with the documents set in the regulation (Article 5).
Violations, penalties and common problems
- If the beneficiary fails to report a change affecting entitlement, hides data or gives false data, payments stop and sums wrongly received must be repaid (Article 7).
Procedures and key deadlines
- The beneficiary must notify the fund of any change affecting entitlement within ten days, and payment stops when the ground for entitlement ends (Article 6).
- Apply once a judgment or court order has been issued and enforcement has stalled, attaching a copy of the judgment and proof of non-payment.
