Sets professional standards for promoting teachers to a higher rank on merit, competence and commitment, and quality standards for teaching staff.

Summary of the law

Purpose and scope

  • The organisational framework supplementing the Teaching Jobs Regulation (1442H), detailing acceptance of qualifications, professional standards, probation, teaching load and assignments, exceptional promotion, professional development, and performance appraisal and grievances.

Key rules, rights and obligations

  • Anyone appointed to a teaching job must meet the professional standards and conditions for practising the profession (Article 4 bis).
  • Probation lasts two full years and is extended by any absence (Article 6); unsuitability is established by an unsatisfactory appraisal in the first or second year or a ground for removal (Article 7), and performance is appraised at least once during it (Article 39).
  • A teacher below the required load may be given a partial assignment until the end of the school year (Articles 9 and 10), and extra periods are paid (Article 12).
  • The minister may promote an outstanding practitioner or advanced teacher before the usual period (Article 15).
  • An administrative assignment may not exceed 4 years, extendable by at most 4 more, after which the teacher returns to the original job (Article 17).
  • Assignments in school health, learning resources, student counselling or activities may not exceed 4 years, renewable (Article 20).

Violations, penalties and common problems

  • Common mistakes: missing the deadline to contest an appraisal, or not following the development plan set after a low appraisal.
  • The direct manager prepares the appraisal and the approving manager approves it, with reference to the notes record (Articles 31 and 32).

Procedures and key deadlines

  • An appraisal may be contested within 10 days of receiving a copy (Article 36).
  • A committee of at least 3 members reviews grievances and sends its recommendation within a month to the minister, whose decision is final (Article 38).
  • An approved appraisal may be changed only with the consent of the competent minister or their deputy (Article 37).
