Implementing Regulation of the Judicial Costs Law

Purpose and scope

• Sets how judicial costs for cases and applications are assessed and collected under the Judicial Costs Law; costs are calculated in whole riyals (Article 10).

Key rules, rights and obligations

• Cases of fixed value: 5% if the claim is below one hundred thousand riyals, 4% from one hundred thousand to below five hundred thousand, 3% from five hundred thousand to below one million, and 2% for one million or more (Article 2).
• The claim value is the amount sought in money cases, the value of the disputed item in cases on a contract's validity or rescission, and the property's value at filing in ownership disputes (Article 2).
• Cases of unfixed value: private criminal claims ten thousand riyals, commercial cases five thousand, and urgent cases, general courts and enforcement disputes three thousand each (Article 3).
• A direct enforcement request is five hundred riyals; other enforcement requests are 2% of the claim, minimum five hundred and maximum ten thousand riyals, borne by the judgment debtor unless the applicant is shown not to be entitled (Article 5).
• Petition for reconsideration ten thousand riyals, cassation seven thousand, appeal five thousand; joinder, recusal, correction, interpretation and stay of execution requests two thousand; an incidental request one thousand (Article 6).

Violations, penalties and common problems

• Common problems: inflating the claim value, which raises costs, and bringing unfounded claims that end with the claimant bearing the costs.

Procedures and key deadlines

• The final assessment is issued after the case ends and notified to the person liable, and costs are collected only after the objection period ends or the objection is decided (Article 8); application costs are assessed after decision, except cassation and reconsideration (Article 9).
• Exemptions and exceptions from costs are set by the Judicial Costs Law itself.
